RESOLUTION REQUESTING AN EARLY TERMINATION TO THE EXISTING CONTRACT WHICH CREATED THE CLINTON-EATON-INGHAM COMMUNITY MENTAL HEALTH AUTHORITY UNDER THE URBAN COOPERATION ACT IN ORDER TO CREATE A COMMUNITY MENTAL HEALTH AUTHORITY



RESOLUTION #02-204



WHEREAS, Ingham County, with Clinton County and Eaton County, formed Clinton-Eaton-Ingham Community Mental Health to provide a Community Mental Health Program; and



WHEREAS, the Ingham County Board of Commissioners desires to improve the quality of mental health services to its residents; and



WHEREAS, pursuant to the Mental Health Code, MCL 330.1001 et seq. (hereinafter referred to as the "Act"), there is an option to create a Community Mental Health Authority with powers and duties as defined in Section 205, MCL 330.1205; and



WHEREAS, the Ingham County Board of Commissioners has determined that a creation of an Authority from the community mental health programs servicing Clinton, Eaton and Ingham Counties (hereinafter referred to collectively as "participating counties" or individually as "participating county") under the Mental Health Authority structure provided in MCL 330.1205 would better serve the County's residents by enhancing the effectiveness of mental health services; and



WHEREAS, the current Agreement under the Urban Cooperation Act requires two (2) years notice of termination, unless the Director of the Michigan Department of Community Health consents to an earlier termination.



THEREFORE BE IT RESOLVED, that Ingham County requests that the Director of the Michigan Department of Community Health consent to an earlier termination date of September 15, 2002 to the existing contract under the Urban Cooperation Act in order to create an Authority pursuant to MCL 330.1205.



BE IT FURTHER RESOLVED, that the creation of the Authority shall be contingent upon Clinton and Eaton Counties passing resolutions with the same terms and conditions.



BE IT FURTHER RESOLVED, that the County Clerk shall forward this Resolution to the Director of the Michigan Department of Community Health.
