RESOLUTION TO AUTHORIZE A CONTRACT OR CONTRACTS FOR THE USE OF BEDS AT THE INGHAM COUNTY CORRECTIONAL FACILITY



RESOLUTION #02-52

WHEREAS, the Ingham County Correctional Facility has a design rated capacity of 575 beds; and



WHEREAS, for many years 103 beds have been leased to the state for its use, leaving 472 beds for local judicial use; and



WHEREAS, the Michigan Department of Corrections has unexpectedly removed their inmates from the jail effective January 22, 2002; and



WHEREAS, the 2002 Ingham County budget anticipated the revenue from this lease; and



WHEREAS, as a result there is a revenue loss to the 2002 county budget exceeding $1 million on an annual basis; and



WHEREAS, it has been determined that it is in the best interests of the county to continue leasing up to 103 beds, if possible; and



WHEREAS, the Sheriff and Undersheriff have been working to identify other entities with an interest in leasing these beds, and



WHEREAS, should such options be found, a contract or contracts will be necessary.



THEREFORE BE IT RESOLVED, that the Ingham County Board of Commissioners authorizes the Sheriff's Office to negotiate a contract or contracts with appropriate municipalities, counties, or agencies of the state or federal government, for up to a total of 103 beds at the Ingham County Correctional Facility at terms no less favorable to the county than which existed in the prior arrangement with the state;



BE IT FURTHER RESOLVED, that the Ingham County Board of Commissioners authorizes the Board Chairperson to sign any necessary contract documents consistent with this resolution, as negotiated and signed by the Sheriff, with approval by the Controller as to the financial terms of the contract and upon approval of the contract as to form by the County Attorney.



BE IT FURTHER RESOLVED, that Sheriff Gene Wrigglesworth and Undersheriff Matthew Myers be commended for their proactive efforts in working to identify revenues replacing those lost by the state's action to remove its prisoners from the county jail.
