INGHAM COUNTY BOARD OF COMMISSIONERS



RESOLUTION AMENDING THE PRISONER HOUSING REIMBURSEMENT POLICY, AND THE CONTRACT WITH THE CREDIT BUREAU OF GREATER LANSING OFFICE



RESOLUTION #03-044



WHEREAS, the State of Michigan has adopted Acts 118 through 121 of the Public Acts of 1984, which in total authorized the seeking of reimbursement from sentenced prisoners for the cost of maintenance and care not to exceed $30.00 per day and cost of medical care if authorized by the appropriate Board of Commissioners resolution; and



WHEREAS, the Board of Commissioners believes it is in the interest of the taxpayers of the county to seek from prisoners reimbursement for the cost of their prisoner maintenance and care and cost of medical care when possible; and



WHEREAS, the daily cost of prisoner maintenance and care is approximately $48.00; and



WHEREAS, the Ingham County Sheriff's Office is now recommending that the Ingham County Board of Commissioners amend the contract with the Credit Bureau of Greater Lansing.



THEREFORE BE IT RESOLVED, that the Ingham County Board of Commissioners hereby rescinds its Prisoner Medical Reimbursement Policy as adopted by Resolution 89-305 and now adopts the following Medical Reimbursement Policy:



Sick call All sentenced Inmates $25.00 per visit

Medication All sentenced Inmates Actual expenses

Outside Medical All Inmates Actual expenses

Services including

hospitalization



BE IT FURTHER RESOLVED, that the Ingham County Board of Commissioners does hereby approve seeking reimbursement from prisoners for the cost of their maintenance and care for their incarceration in the Ingham County Jail at the rate of $25.00 per day for sentenced inmates. It is further understood that those inmates who choose to pay their bill within the first 10-days upon release will receive a 50% reduction of their bill.



BE IT FURTHER RESOLVED, that the Ingham County Board of Commissioners hereby approves amending the contract with the Credit Bureau of Greater Lansing effective from March 1, 2003 through December 31, 2004 to seek reimbursement for the cost of prisoner maintenance and care, and medical expenses as described in this resolution.



BE IT FURTHER RESOLVED, that the maximum charge for housing shall not exceed $6,825 in any calender year, except for days served on work release status, unless otherwise set by the sentencing Judge.

RESOLUTION #03-044



BE IT FURTHER RESOLVED, that as a part of its service in seeking reimbursement for prisoner maintenance and care, the Credit Bureau of Greater Lansing is authorized in its discretion to report the uncollected debt on the inmate's credit report in accordance with the Fair Credit Reporting Act, P.A. 211 of 1989, and/or institute a lawsuit in the name of the County to obtain payment for prisoner maintenance and care pursuant to and in accordance with the requirements of 15 USC 1681 et seq and medical expense reimbursement pursuant MCL 801.51, upon approval of the Ingham County Law Enforcement Committee.



BE IT FURTHER RESOLVED, that the Chairperson of the Ingham County Board of Commissioners is hereby authorized to sign any contractual documents consistent with this resolution subject to the approval as to form by the County Attorney.



BE IT FURTHER RESOLVED, that these policies will go in effect March 1, 2003.



BE IT FURTHER RESOLVED, that the Law Enforcement Committee will review this Inmate Billing Policy six months after its implementation to determine its effectiveness.



BE IT FURTHER RESOLVED, that the Controller is authorized to amend the 2003 budget to reflect added revenues of $75,000 designated as a result of this program in the Sheriff's Office budget as identified in this proposal.



BE IT FURTHER RESOLVED, that the Chairperson of the Ingham County Board of Commissioners and the County Clerk are authorized to sign any contract documents consistent with this resolution and approved as to form by the County Attorney.
