RESOLUTION TO AUTHORIZE BUSINESS ASSOCIATE AGREEMENTS AS REQUIRED BY THE HEALTH INSURANCE PORTABILITY AND

ACCOUNTABILITY ACT

RESOLUTION #03-84

WHEREAS, the Health Insurance Portability and Accountability Act of 1996 (HIPAA) requires covered entities to enter into agreements with their business associates, effective April 14, 2003; and

WHEREAS, HIPAA protects protected health information of individuals; and

WHEREAS, the Ingham County Health Department and the Ingham County Medical Plans covering County employees are hybrid covered entities; and

WHEREAS, a business associate is an individual or company that provides a function or activity for the covered entity involving the use or disclosures of the protected health information; and

WHEREAS, under these agreements, Business Associates shall agree to treat protected health information in the same manner as the covered entities; and

WHEREAS, the Ingham County Health Department and the Ingham County Medical Plans have business associates, who provide such services.

THEREFORE BE IT RESOLVED, that the Ingham County Board of Commissioners authorizes agreements to be entered into with their respective business associates.

BE IT FURTHER RESOLVED, that the Board Chairperson is authorized to sign such Business Associate Agreements after review by the County Attorney.
