INGHAM COUNTY BOARD OF COMMISSIONERS

 

RESOLUTION OPTING OUT OF A TAX CAPTURE FOR THE EXPANDED MASON DDA DISTRICT

 

RESOLUTION #04-341

 

WHEREAS, Ingham County has received a notice from the City of Mason that it is intending to expand the boundaries of its Downtown Development Authority District; and

 

WHEREAS, current law permits counties to not allow the capture of its property taxes where an existing DDA is expanding its boundaries; and

 

WHEREAS, through adoption of Resolution #95-174, the Board of Commissioners has adopted a policy which provides that to the extent provided by law, the County will not permit the capture of its property tax revenues unless a tax sharing agreement has been approved; and

 

WHEREAS, no such tax sharing agreement currently exists; and

 

WHEREAS, the County Controller and the Ingham County Economic Development Corporation are recommending that the capture of property taxes not be permitted unless a tax sharing agreement has been approved.

 

THEREFORE BE IT RESOLVED, that to the extent provided by law, the Board of Commissioners  will not permit the capture of its property taxes within the expanded DDA District of the City of Mason until such time as a tax sharing agreement meets the conditions of Resolution #95-174 and is approved by the Board of Commissioners.

 

BE IT FURTHER RESOLVED, that the County Controller and the Economic Development Corporation are requested to work with the City of Mason and the Mason DDA to develop a suitable tax sharing agreement for consideration by the Board of Commissioners.

 

BE IT FURTHER RESOLVED, that the County Clerk is directed to send a copy of this resolution to the City of Mason and to the Mason Downtown Development Authority.
