RESOLUTION AUTHORIZING A LEASE AGREEMENT WITH CINGULAR WIRELESS TO CONSTRUCT A 130’ STEALTH FLAG POLE ON HOUSING COMMISSION DESIGNATED PROPERTY

RESOLUTION #06-262

WHEREAS, the Ingham County Housing Commission has been approached by Cingular Wireless and offered a lease for the purpose of constructing a 130’ flag pole to be used as a cell tower; and

WHEREAS, the Ingham County Housing Commission has reviewed information from Cingular Wireless regarding placement of the tower, safety concerns, compensation, and lease agreement; and

WHEREAS, the Ingham County Housing Commission and the residents it serves would benefit from the financial arrangement of such a lease; and

WHEREAS, the Ingham County Housing Commission approved entering into a lease agreement with Cingular Wireless for the purpose of constructing a flag pole cell tower on property designated for use by the Ingham County Housing Commission at a lease rate of $1,200 per month on a five-year initial term, with four automatically renewable five-year terms, and a 3% annual escalator over the base rent.

THEREFORE BE IT RESOLVED, that the Ingham County Board of Commissioners approves the acceptance of the lease offer from Cingular Wireless for the purpose of constructing a flag pole cell tower on property designated for use by the Ingham County Housing Commission at a lease rate of $1,200 per month on a five-year initial term, with four automatically renewable five-year terms, and a 3% annual escalator over the base rent.

BE IT FURTHER RESOLVED, that Cingular Wireless will be responsible for all costs to construct and operate the site.

BE IT FURTHER RESOLVED, that revenue from the lease will be used for the operation of Carriage Lane Apartments.

BE IT FURTHER RESOLVED, that the Ingham County Board of Commissioners authorizes the Board Chairperson and the County Clerk to sign any necessary documents that are consistent with this resolution and approved as to form by the County Attorney.
