A regulation to require a license for the retail sale of tobacco, prohibit sale of tobacco to minors and to restrict location of tobacco vending machines.
This regulation became effective January 1, 1993 and was
amended November 27, 2007. As of the

Highlights of the Regulation
Sales
As of the effective date of this regulation, it is unlawful for a person to sell or attempt to sell or deliver tobacco products to an individual under eighteen (18) years of age. The retailer must positively establish the purchaser’s age of eighteen (18) years or older.
Signs Required
Signs informing the public of the age restrictions provided for in this regulation must be posted by every retailer at or near every display of tobacco products, at the point of sale, and on or upon every vending machine which offers tobacco products for sale.
Licensing Fees
Licenses are issued for a one-year period. As of January 1, 2008, the fee for a license for the retail sale of tobacco is $250.00.
Violation of the Regulation
Any licensed tobacco retailer who violates any provision of this regulation is assessed a monetary civil penalty of $50.00 for the first violation; $250.00 for a second violation; $500.00 for a third violation; and $1,000.00 for fourth and subsequent violations.
License Suspension
and Revocation
A tobacco retailer’s license may be suspended or revoked by the Health Officer for cause if the licensee fails to comply with the provisions of this regulation.
Appeals
An alleged violator may appeal a citation in writing within
twenty (20) days of the citation to the Health Officer of the Ingham County
Health Department,
