INGHAM
RESOLUTION CONDITIONALLY AUTHORIZING AN EXCHANGE OF
PROPERTY WITH THE ARTHUR W. JEWETT TRUST AND THE ALICE L. JEWETT TRUST
RESOLUTION #04-348
WHEREAS,
through Resolution #04-172, the Board of Commissioners conditionally authorized
a lease of a portion of the Ingham County Fairgrounds
for the purpose of constructing a sports complex; and
WHEREAS,
the project involves the construction of a new road to the east of the
Fairgrounds, and new entrances, which is of benefit to the operation of the
fairgrounds; and
WHEREAS,
the design of the project will require a portion of the property at the
Fairgrounds to be used as the new road’s right of way; and
WHEREAS,
it is anticipated that the construction of the road will occur regardless of
whether or not the sports complex is constructed; and
WHEREAS,
to most beneficially align the property lines of the fairgrounds with the
construction of the new road, it is desirable to exchange less than an acre of
fairgrounds property with an approximately equal amount of property owned by
the Arthur W. Jewett Trust and the Alice L. Jewett Trust; and
WHEREAS,
the proposed property exchange has been reviewed by the Ingham
County Fair Board, who is recommending that the exchange of property be
approved regardless of whether or not the sports complex is constructed.
THEREFORE
BE IT RESOLVED, that the Ingham County Board of
Commissioners accepts the recommendation of the Ingham
County Fair Board to authorize the property exchange.
BE IT
FURTHER RESOLVED, that the Board of Commissioners authorizes the exchange of
property between Ingham County and the Arthur W.
Jewett Trust and the Alice L. Jewett Trust (the Trusts), consisting of less
than one acre and as identified on the attached map, at such time that the City
of Mason has given its final approval and obtained funding for the construction
of the new road.
BE IT
FURTHER RESOLVED, that the Trusts shall be responsible
for providing acceptable surveys and legal descriptions, and for the payment of
any other costs to the County which are incurred in this transaction.
BE IT
FURTHER RESOLVED, that the Board Chairperson and
documents
as approved to form by the County Attorney, contingent upon receiving official
notice from the City of Mason that it has given approval and committed funds to
the construction of the road.
BE IT
FURTHER RESOLVED, that this resolution is null and void if by December 31,
2005, the City of
