RESOLUTION TO RESCIND RESOLUTION # 04-93, CREATE A NEW ATTORNEY/REFEREE POSITION WITHIN THE JUVENILE DIVISION/FAMILY COURT, AUTHORIZE A CONTRACT AMENDMENT TO THE CIRCUIT COURT/FAMILY DIVISION 2003/04 CHILD CARE FUND BUDGET AND AUTHORIZE THE USE OF JUVENILE JUSTICE MILLAGE FUNDS

WHEREAS, the 30th Circuit Court/Family Division demonstrated the need for a new Attorney Referee/Circuit Court position within the Family Division of Circuit Court and the Ingham County Board of Commissioners authorized the creation of this position to be funded by the Child Care Fund and Juvenile Justice Millage funds through Resolution # 04-93; and



WHEREAS, the 30th Circuit Court/Family Division is proposing a revised funding plan for this position that recognizes that the three current Intake Referee positions will be spending one-half of their time assessing the risks and needs associated with the children going through the court system to make the most appropriate recommendations regarding the treatment plans and detention recommendations if necessary for these children.



THEREFORE BE IT RESOLVED, that the Ingham County Board of Commissioners hereby approves the 30th Circuit Court/Family Division revised request and authorizes the creation of one (1) new Attorney Referee/Circuit Court position within the Family Division of Circuit Court effective May 1, 2004 under a new job description approved by the Human Resources Department and the OPEIU contractual salary benefit range.



Attorney Referee/Circuit Court Salary Range: $63,611 - $76,360



BE IT FURTHER RESOLVED, that the January 1, 2001 through December 31, 2005 collective bargaining agreement between Ingham County, 30th Judicial Circuit Court/Family Division, and the Office and Professional Employees International Union, Local 459, AFL-CIO for the Circuit Court/Family Division Professional Employees be amended to incorporate this new position and its corresponding salary range.



BE IT FURTHER RESOLVED, that the three Intake Referee Positions will now be Child Care Fund positions to be funded 50 % General Fund, 25% Child Care Fund, and 25% Juvenile Justice Millage effective May 1, 2004.



BE IT FURTHER RESOLVED, that the Ingham County Board of Commissioners authorizes amending the 2003/04 Child Care Fund contract with the transfer of the three Intake Referee positions General Fund personnel expenses ($ 167,603) to the Child Care Fund to be funded by a General Fund appropriation of fifty percent of the costs ( $ 83,802) to the Child Care Fund with a corresponding increase of revenues from the Juvenile Justice Millage in the amount of $ 41,901 and from the State Child Care Fund in the amount of $41,901.



BE IT FURTHER RESOLVED, that the 2004 costs of a new Attorney Referee/Circuit Court position ($ 58,332) and up to $4,000 for the office equipment/furniture will be funded with the $83,802 General Fund savings from the transfer of the three Intake Referee positions to the Child Care Fund.

RESOLUTION #04-112



BE IT FURTHER RESOLVED, that the Ingham County Board of Commissioners authorizes the Controller to make the necessary budget adjustments and Position Allocation List amendment in the Circuit Court 2003/04 budget.



BE IT FURTHER RESOLVED, that approval of this request for the period May 1 through December 31, 2004 shall create no expectation of the continuation of the position in the 2005 budget.



BE IT FURTHER RESOLVED, that the level of personnel hours required in continuing implementation of the new assessment process shall be evaluated further prior to the 2005 budget process.



BE IT FURTHER RESOLVED, that consideration of whether to allocate funds for such a position in 2005 shall be made only as part of the County's broader determination of priorities in the needs of the juvenile justice system.



BE IT FURTHER RESOLVED, that the Chairperson of the Board of Commissioners and the County Clerk are hereby authorized to sign any necessary contract documents consistent with this resolution and approved as to form by the County Attorney.



BE IT FURTHER RESOLVED, that Resolution # 04-93 is hereby rescinded.
