INGHAM COUNTY BOARD OF COMMISSIONERS

 

RESOLUTION AUTHORIZING A REVISED TERM OF THE LEASE WITH THE COMMUNITY MENTAL HEALTH BOARD OF CLINTON, EATON, AND INGHAM COUNTIES

FOR THE OLD SHERIFF’S RESIDENCE


RESOLUTION #04-279

 

WHEREAS,  the Ingham County Board of Commissioners authorized the lease of the old sheriff’s facility to the Community Mental Health Board (CMHB) for the purpose of operating a  residential substance abuse treatment facility at that site for a maximum of 6 beds; and

 

WHEREAS, that  in order for the CMHB to provide these services, the Ingham County Board of Commissioners authorized the renovation of  the building in accordance with the CMHB specifications; and

 

WHEREAS, the Ingham County Board of Commissioners authorized the lease of the old sheriff’s facility to the CMHB, under  the terms that the lease will provide that the CMHB will pay for all maintenance and operating expenses plus the capitalized costs of expenses for renovating the building over 10 years; and 

 

WHEREAS, CMHB has notified the County that their contract with the State Department of Community Health (DCH) requires a 20 year amortization for leasehold improvements rather than the 10 years as originally approved by the Board of Commissioners; and

 

WHEREAS, CMHB is requesting a 20 year lease of the old sheriff’s facility to the CMHB.

 

THEREFORE BE IT RESOLVED, that the Ingham County Board of Commissioners approves a  revised term of the old sheriff’s facility lease with the CMHB increasing the term from 10 years to 20 years, annually renewable unless one is notified by the other one year in advance that the lease is to be terminated; provided however, that the lease can be terminated within the 20 year period upon one year’s notice, but if such notice is given by CMHB, then CMHB shall repay the County the balance of any unamortized costs.

 

BE IT FURTHER RESOLVED, that the Chairperson of the Board of Commissioners and the County Clerk are authorized to sign any contract/lease documents consistent with this resolution and approved as to form by the County Attorney.
