RESOLUTION TO WAIVE THE INGHAM COUNTY ANIMAL CONTROL SHELTER POLICY WITH RESPECT TO ANIMAL ADOPTIONS FOR A UNIQUE INCIDENT

WHEREAS, the Ingham County Board of Commissioners has a long standing Animal Control Adoption Policy that specifies that the public acknowledge and sign an Adoption Contract that states that they accept any animal they adopt from the Shelter “as is” with no expectation that any costs associated with veterinary expenses or euthanizing animals would be reimbursed by the County other than circumstances as specified by the contract; and
WHEREAS, the Board of Commissioners has referred a citizen’s request to the waive this policy for a specific unique incident to the Animal Control Shelter Advisory Committee for a review of the incident and recommendation; and
WHEREAS, the Law Enforcement Committee discussed the incident with the citizen requesting the waiver and reviewed the recommendation of the Animal Control Shelter Advisory Committee at a Law Enforcement Committee meeting; and
WHEREAS, the Law Enforcement Committee is recommending a waiver of the Animal Control Adoption Policy to the Ingham County Board of Commissioners.
THEREFORE BE IT RESOLVED, that the Ingham County Board of Commissioners hereby grants a waiver of the Animal Control Adoption Policy and offers Ms. Barbara Kimmel the option of:
1) Selecting another animal from the Shelter and adopt it under the same contract provisions, at no charge for the next year, effective the date of the passage of this resolution.
2) Compensation in the amount of $91.00 for the costs of euthanizing an animal adopted from the Ingham County Animal Control Shelter.
BE IT FURTHER RESOLVED, that this offer is contingent upon Ms. Kimmel signing a waiver of further claims, as prepared by the County attorney.
BE IT FURTHER RESOLVED, that the Ingham County Board of Commissioners reaffirms its long standing Animal Control Adoption Policy.
BE IT FURTHER RESOLVED, that the Ingham County Board of Commissioners commends the Animal Control Shelter staff and Animal Control Shelter Advisory Committee for the appropriate actions they took in relation to this unique incident.

BE IT FURTHER RESOLVED, that the Ingham County Controller is directed to transfer up to $91.00 from the 2007 County Contingency Fund to the Ingham County Animal Control Budget in order to reimburse Ms. Kimmel should she choose this option.
