INGHAM COUNTY BOARD OF COMMISSIONERS

RESOLUTION PROVIDING CONSENT TO MORTGAGE BY THE COMMUNITY MENTAL HEALTH AUTHORITY OF CLINTON-EATON-INGHAM COUNTIES OF LAND AT 821 EAST JOLLY ROAD, LANSING, MICHIGAN

RESOLUTION #09-304

WHEREAS, Resolution #08-201 authorized the sale of County-owned real property located at 821 East Jolly Road, Lansing, Michigan to the Community Mental Health Authority of Clinton-Eaton-Ingham Counties; and

WHEREAS, the Community Mental Health Authority of Clinton-Eaton-Ingham Counties desires to take out a mortgage loan of $180,000 to construct a storage facility on this property; and

WHEREAS, as a condition of the sale of the property, Ingham County retains an option to repurchase the land; and

WHEREAS, during this option period, the Community Mental Health Authority of Clinton-Eaton-Ingham Counties may not, without the express written consent of Ingham County, sell or otherwise dispose of the real estate; and

WHEREAS, since the Community Mental Health Authority of Clinton-Eaton-Ingham Counties mortgaging of the land to the bank may conditionally result in a disposition of the land, the County’s consent is necessary.

THEREFORE BE IT RESOLVED, the Ingham County Board of Commissioners hereby consents to an $180,000 mortgage to be given by the Community Mental Health Authority of Clinton-Eaton-Ingham Counties as mortgagor, to JP Morgan Chase Bank as mortgagee.

BE IT FURTHER RESOLVED, that the Ingham County Board of Commissioners approves the attached consent document, and the Controller/Administrator is authorized to sign the attached consent document after approval as to form by the County Attorney.
